What is it? Infringement is the use of a trademark in a way that is confusingly similar to another companys trademark, without that companys prior permission. While consumer confusion is the touchstone to an infringement lawsuit, actual confusion of a consumer it is not required in order for infringement to exist. All that matters is that an appreciable number of consumers are likely to be confused about the source of the underlying goods or services.
